The Foreign Investment in Real Property Tax Act of 1980, commonly referred to as FIRPTA, is principally contained in Internal Revenue Code §§ 897 and 1445. FIRPTA is intended to ensure that foreign persons pay US federal income tax on gains arising from investments in US real property.
