Bar Council of India Issues Clarifications on Entry of Foreign Lawyers and Law Firms in India

19 March 2023 Press Release clarifies several points of the new regulations permitting foreign lawyers and law firms to practice in India

Further to the recent announcement that foreign lawyers and law firms will be permitted to operate in India, the Bar Council of India has on 19 March 2023 clarified that foreign lawyers and law firms will be allowed to advise on foreign laws only. They will be permitted to render such advice to their foreign clients only. They will only be allowed to function in non-contentious areas of law and will not be allowed to appear before any court, tribunal or any statutory or regulatory authority. The entry of foreign lawyers will be on a reciprocal basis i.e. only if a foreign country allows Indian lawyers to practice in it, will lawyers from those countries be allowed to practice in India. The Bar Council has reiterated that the principle of reciprocity is of the essence of the new regulations.

Michelle read law for 3 years at the Government Law College in Mumbai, and then completed a 3 year Bachelor of Laws degree at the University of London, School of Oriental and African Studies. She subsequently completed the Legal Practice Course at the College of Law in London before joining Clifford Chance London in 2007. She has been a practicing Solicitor of England & Wales from 2009. She joined Solomon & Co. in 2012 after practicing law at Clifford Chance for 5 years, both in their London and Paris offices.
